Straight rental. The equipment always belongs to the Owner, and no part of the rent builds toward ownership.
The Owner rents the Renter the equipment listed above (the "Equipment"). The Equipment is and stays the Owner's property at all times. This is a rental only: renting does not make the Renter the owner, and no part of any payment builds toward ownership.
Rent is the monthly amount above, plus any sales tax the law requires. The first month's rent, and any delivery fee, is due at delivery. After that, rent is due on the of each month. This agreement runs month to month until ended under Section 8.
The Owner delivers the Equipment, installs it, and confirms it runs before leaving. If the Equipment stops working through normal use, the Owner repairs or replaces it at no charge. The Renter agrees to report problems promptly and not to repair or modify the Equipment, or have anyone else do so.
The Owner is not responsible for damage, loss, or injury caused by the home's own electrical or plumbing systems, including surges, faults, fire, leaks, flooding, drain backups, or moisture damage, or by hookups that are faulty, outdated, improperly grounded, or not up to code. If a pre-existing electrical or plumbing problem is found, the Renter is responsible for having it corrected by a licensed professional before installation or continued service.
The Equipment is pre-owned, delivered in good working order but accepted by the Renter as used equipment with normal cosmetic wear. The Owner's responsibility is limited to repairing or replacing the Equipment itself. The Owner is not responsible for damage to clothing or other property caused by the Equipment, including tearing, staining, shrinking, or damage from a leak or malfunction. If a unit is not working correctly, the Renter agrees to stop using it and tell the Owner right away.
If rent is more than days past due, the Owner may end this rental after notifying the Renter, and will schedule a pickup of the Equipment. The Renter still owes any unpaid rent through the pickup date.
On termination for any reason, the Renter agrees to return the Equipment or make it available for pickup within 7 days of the Owner's request, at reasonable times. If the Equipment is not returned or made available within those 7 days, the Renter agrees the Equipment will be treated as not returned and the per-unit replacement value in Section 4 becomes due, and the Owner may pursue any lawful means of recovering the Equipment or its value, including small claims court. Nothing in this agreement gives the Owner a right to enter the Renter's home without permission.
Either party may end this rental with days' notice. When it ends, the Owner picks the Equipment up at no charge. The Equipment should be in the condition it was delivered in, aside from normal wear.
This is the entire agreement between the parties and replaces any prior discussion. It is governed by the laws of the State of . If any part of it is found unenforceable, the rest stays in effect.
